Terms of Service

is a free, community-maintained map of frozen drink machines. Every location, opening time, flavour and status on it is submitted by members of the public. We do not visit these places, we do not verify what is submitted, and we do not control what anyone writes.

The Service is provided for general information and entertainment. It is not a directory of businesses we endorse, represent or have any relationship with.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY AND QUIET ENJOYMENT.

We do not warrant that any information on the Service is accurate, complete, current or useful; that any machine listed exists, works, is open, is safe, or pours what it is said to pour; that any business listed is trading; that the Service will be available, uninterrupted, secure or error free; or that defects will be corrected.

Any reliance you place on the Service is entirely at your own risk. If you travel somewhere because of something you read here, that journey and everything that happens on it is your responsibility, including where the location is wrong, the machine is broken, the shop is closed or gone, or the entry was fabricated.

You are responsible for your own safety and for obeying the law, including road traffic law. Do not use the Service while driving. Locations are approximate and may be on private property; entering premises is a matter between you and whoever controls them.

TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER EVER ONWARD LLC NOR ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS OR AGENTS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR ANTICIPATED SAVINGS, ARISING OUT OF OR RELATING TO THE SERVICE, ON ANY THEORY OF LIABILITY, WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THIS INCLUDES, WITHOUT LIMITATION, ANY CLAIM ARISING FROM: INFORMATION ON THE SERVICE BEING WRONG, OUT OF DATE OR MALICIOUS; ANY ACT OR OMISSION OF ANOTHER USER; ANY THIRD PARTY BUSINESS, PRODUCT, WEBSITE OR SERVICE LINKED TO OR DESCRIBED HERE; PERSONAL INJURY, ILLNESS OR PROPERTY DAMAGE SUFFERED IN CONNECTION WITH VISITING A LISTED LOCATION OR CONSUMING ANYTHING BOUGHT THERE; UNAVAILABILITY OR LOSS OF DATA; AND UNAUTHORISED ACCESS TO YOUR ACCOUNT.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO ONE HUNDRED UNITED STATES DOLLARS ($100), OR THE AMOUNT YOU HAVE PAID US IN THE PRECEDING TWELVE MONTHS, WHICHEVER IS GREATER. THE SERVICE IS FREE, SO THAT AMOUNT IS ORDINARILY ZERO.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, for fraudulent misrepresentation, or for death or personal injury caused by our own negligence. Some jurisdictions do not allow the exclusion of implied warranties or of incidental or consequential damages, so parts of the two sections above may not apply to you. Where a limitation is held unenforceable, it applies to the greatest extent the law allows and the rest of these terms remain in force.

You are solely responsible for anything you submit, and you confirm that you have the right to submit it and that it is accurate to the best of your knowledge. Do not submit anything unlawful, defamatory, harassing, deceptive, or infringing on someone else’s rights, and do not submit photographs of identifiable people without their permission.

You keep ownership of what you submit. You grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable licence to host, store, reproduce, adapt, publish and display it in connection with operating and promoting the Service. Submissions are public.

We may edit, hide, archive or remove any submission, and suspend or delete any account, at any time and for any reason or none, without notice and without liability to you.

You must be old enough to form a binding contract where you live. You are responsible for your account and for everything done through it. Tell us promptly if you believe it has been compromised.

The Service links to third party sites and may contain affiliate links, including Amazon Associates links, from which we may earn a commission on qualifying purchases at no additional cost to you. We do not control those sites and are not responsible for them, their content, their products, or anything you buy through them. Your dealings with them are entirely between you and them.

is an independent project. Slush Puppie and any other product or company names on the Service are the trade marks of their respective owners, used for identification only. We are not affiliated with, endorsed by, sponsored by, or connected to any of them.

You agree to indemnify and hold harmless Ever Onward LLC and its members, managers, officers, employees, contractors and agents from any claim, demand, loss, liability, cost or expense (including reasonable legal fees) arising out of your use of the Service, anything you submit, or your breach of these terms.

We may change, suspend or discontinue the Service, in whole or in part, at any time without notice. We may revise these terms at any time; the version published here is the one in force, and continuing to use the Service after a change means you accept it.

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. You agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute that is not otherwise resolved.
